PINOYFITNESS INC. (“us”, “we”, or “our”) operates PINOYFITNESS (the “App”). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the App.
By using the App you agree to the collection and use of information in accordance with this policy.
We will provide the users with a Personal Information Collection Statement in an appropriate format and manner whenever we collect personal data.
1. Privacy
You agree to the App’s privacy policy which explains how we collect, protect and utilize the information you supply us. We will keep all information obtained from you confidential, and will only otherwise disclose it with your permission and authorization. You accept and agree that we may reveal any pertinent information in order to protect and/or defend App’s in any actual or threatened legal, civil or regulatory undertaking. Without your consent, we will not act where a conflict exist.

We collect all the data you directly provide to us through the App and other subsequent communication channels. These data may come to us when you create or modify your account, subscribe to the App’s services, contact customer support, or otherwise communicate with us. This information may include, but are not limited to, the following: name, email, phone number, postal address, payment method, government identification numbers, including, but not limited to TIN, SSS numbers; utility account numbers, services requested (for delivery of services), and other information you choose to provide.
b. Information we collect through your use of our services
We collect transaction details related to your use of our services, including the type of service requested, date and time the service was requested and provided, amount charged, and other related transaction details.
In order for the App to properly execute its transactions, we will require the following personal information from its users:

We also collect information regarding your device such as the email address used in the operating system of the device, and the files in the device.
c. Information we collect through images
We collect user information based on the images you upload to our system, this is used as a facility to help keep track of the progress of the user, including the location of where the photo was taken as a user optional input, short description of the photo, and the distance and time indicated in the photo.
In order for the App to properly execute its function, we will require the following information its users:

d. Information we collect from other sources
If you choose to link, create, or log in to your App account with a payment provider (e.g. PayPal) or social media service (e.g. Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app.
If your employer uses one of our enterprise solutions, such as the payment for local government contributions, we may receive information about you from your employer.
All information we receive from other sources may be combined with the information we collect though our services.
All of the information that we collect, as stipulated above, are stored in our cloud and back-up servers that have up-to-date computer safeguards such as firewalls and data encryption, and physical access controls.
1.2) USE OF INFORMATION:
We may use the data we collect about you for the following purposes:
a. For documentation and processing of:
Application and payment of events and promos; and,
To provide, maintain, and improve our services,
To perform internal operations, including, for example, to prevent fraud and abuse of our services,
To send you communications we think will be of great importance and interest to you, including information about products, services, promotions, news, and events of PINOYFITNESS and other related companies, and to personalize and improve the services of the App including to provide or recommend features and content.
The data collected, particularly during the sign up, will also be used in the marketing of upcoming features of the app as well as reminders for users of upcoming deadlines and new rules and policies. These will be done via email and SMS communication.
1.3) SHARING OF INFORMATION:
We may share the information you provide to us with:
Third parties whom we have partnerships with to provide you a service you requested or those with an API or service with which we integrate to;
PINOYFITNESS subsidiaries and affiliated entities that provide services or conduct data processing on our behalf, or for data centralization purposes;
Vendors, consultants, marketing partners and other service providers who need access to such information to carry out work on our behalf;
The general public if you submit content in a public forum or other features of our services that are viewable by the general public;
People whom you registered to the App for the processing of payments, contributions, and bills, on their behalf; and/or,
Law enforcement officials, government authorities, or other third parties if we believe your actions are inconsistent with this Agreement, if we need to protect the rights, property, or safety of PINOYFITNESS or others, or if there is a request for information by a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process.
1.4) PURPOSE OF COLLECTION AND USE OF PERSONAL DATA:
PINOYFITNESS reserves the right to collect and use your personal information for the following purposes:
To comply with any applicable law, regulation, legal process and/or government request, including but not limited to customer due diligence, anti-money laundering and anti-terrorism financing-related purposes;
To improve the App’s products and/or services;
To fulfill your requests when using our services;
To personalize any of our services and products for you and to deliver targeted advertisements and offers from us and third parties;
For any billing requirements and to maintain relevant payment records;
To respond to any claims by third parties or in response to any potential breach of any agreements or policies that govern your use of the App;
To protect the rights of the App including but not limited to the security or integrity of the App;
To identify and resolve technical problems relating to the App and our products and/or services; and/or
For our business or operational analysis, marketing and other promotional purposes.
1.5) DATA DELETION

2. Consent for collection, use, and disclosure
Your use of the App’s services constitutes your consent to the terms of this Privacy Policy.
PINOYFITNESS will notify you by email regarding material changes to this Privacy Policy that will affect information collected from you in the future. In certain circumstances, however, PINOYFITNESS may not notify you, for example, in cases relating to any contravention of the law by you, collection of debt owed to us or compliance with requests from law enforcement agencies or a court order.
By continuing to access and use the service on the App, you are deemed to have accepted any changes to the provisions of this Privacy Policy.
You may withdraw your consent under this Privacy Policy at any time by sending an email using PINOYFITNESS contact form. Please note that in the event you withdraw your consent, PINOYFITNESS may suspend its provision of products and/or services to you.
3. Disclosure, processing, and retention of data
3.1) Personal information collected from you may also be transferred to a third party:
In the event PINOYFITNESS engages its affiliates and/or other third parties to provide certain products and/or services to you on the App’s behalf. In such cases, PINOYFITNESS will only provide information to such third parties on a ‘need to know’ basis, and PINOYFITNESS will limit their rights to use and further disclose your personal information as appropriate in the course of their work for PINOYFITNESS;
To verify the accuracy of the personal information that has been provided to us;
To detect, prevent or otherwise address fraud, security or technical issues;
In the event we are required to do so because of an applicable law, court order or governmental regulation, or if such disclosure is otherwise necessary in support of any criminal or other legal investigation or proceeding here or abroad.
To refer the customer’s information to criminal investigating authorities to verify the identity of the customer or the beneficial owner in the event that the amount of the transaction of the customer reaches a certain threshold or once they engage in remittance transactions if there is a reason to doubt:
The accuracy of the information relating to the customer’s identity:
That the customer is the beneficial owner; or
The intermediary’s declaration of beneficial ownership, or
If there are any signs of unreported changes.
3.2) Information relating to bank accounts and other financial information will never be disclosed to anyone through this App, unless PINOYFITNESS must do so to comply with any applicable law, regulation, legal process and/or government request.
3.3) Where personal information is shared with third parties, PINOYFITNESS will exercise all reasonable endeavors to ensure that such third parties keep your personal information secure.
3.4) After your account becomes inactive (that is, if you request to be removed from PINOYFITNESS database), PINOYFITNESS will keep your personal information in its archives for a duration as may be required under any applicable laws or regulations. Your information will be used only as necessary for tax purposes or to prove PINOYFITNESS ‘s compliance with any applicable law.
3.5) The data we collected shall be retained for a period of one year, after which they shall be destroyed and disposed in a secure manner such as shredding or digital deletion and overwriting. Hard copies that include personal and/or sensitive information, such as receipts and tax returns, shall be kept secured for a period of 10 years as mandated by the respective government agencies concerned. These hard copies will be open to the users should they wish to obtain and dispose of it.
3.6) Physical storage of hard copies are to be kept secured through a document management system. After the required retention period, these shall likewise be disposed of in a secure manner.
3.7) Due to the sensitive and confidential nature of the personal data under the custody of the company, only the client and our authorized representative shall be allowed to access such personal data, for any purpose, except for those contrary to law, public policy, public order or morals.
4. Access and updates to personal information
You have the right to access and review any personal information PINOYFITNESS has collected and retained from you.
You are responsible for informing PINOYFITNESS about changes to your personal information from time to time and have the right to request for the amendment of inaccurate or incomplete personal information by submitting a request via email to PINOYFITNESS. PINOYFITNESS will screen and verify all requests before effecting the corrections. Once verified, PINOYFITNESS will effect the corrections or updates as soon as commercially feasible.
In order to verify your personal information, PINOYFITNESS may request you to provide supporting documentation to corroborate the personal information provided.
5. Security Safeguards
PINOYFITNESS protects your personal information by:
Restricting third party access to any personal information;
Maintaining relevant software and technology within the App and payments platform to prevent unauthorized computer access; securely destroying your personal information when it is no longer needed for any legal or business purpose.
PINOYFITNESS uses SSL (secure socket layer) encryption technology when processing your financial details to keep your personal information safe and secure.
If you believe that your personal information on the App has been breached or compromised, please contact PINOYFITNESS immediately.
Your password is the key to your account. PINOYFITNESS encourages you to use unique numbers, letters and special characters. Do not share your App’s password to anyone. If you share your password with others, you will be responsible for all actions taken in the name of your account and you could also be subject to legally binding actions taken on your behalf. If your password has been compromised, or you have grounds to believe it has been compromised, for any reason, you should immediately contact PINOYFITNESS and change your password.
You are reminded to log off from your account and close the browser when finished using a shared computer.
The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
Your personal information will be stored in a database for one (1) year after your account is closed after which physical records shall be disposed of through shredding, while digital files shall be anonymized.
6. App Analytics
PINOYFITNESS uses third-party applications to analyze the App traffic data for us. Data generated is not shared with any other party. Only non-identifiable App traffic data are analyzed, including:
Your IP address
The search terms you used
The pages and internal links accessed on our app
The date and time you visited the app
Geo-location
The referring site or platform (if any) through which you clicked through to this site
Your operating system
7. Communications
PINOYFITNESS may use your Personal Information to contact you with notices, newsletters, marketing or promotional materials.
8. Access and Corrections

9. Effectivity
This Privacy Policy is based on the Data Privacy Act of 2012 and will be effective as of May 2018 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
10. Non-disclosure
Members of PINOYFITNESS, such as app developers and administrators shall uphold the utmost confidentiality in handling personal data. PINOYFITNESS binds its employees to non-disclosure agreements extending beyond contractual relations.
Since the app’s services are outsourced, employees of PINOYFITNESS’S partners are likewise bound by non-disclosure and data sharing agreements in handling personal data. Due diligence is regularly conducted by PINOYFITNESS’S personnel to ensure that partners who process the transactions dutifully implement the proper security measures. Other than our service providers, personal data provided to PINOYFITNESS shall only be disclosed pursuant to a lawful purpose, and to authorized recipients of such data.
11. Changes
We may change this privacy policy to comply with government and regulatory requirements; to adapt to new technologies and protocols; or for other legitimate purposes. You will always be notified of these changes and we will also be obtaining your consent to the new privacy policy, if any.
